We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains how we collect, hold, use and disclose your personal information, including sensitive health information.
A note on sensitive information. Medical cannabis is a prescription-only medicine. As part of providing and supporting access to our products, we may handle sensitive health information. We only collect this with your consent and where reasonably necessary, and we hold it to a higher standard of protection under the APPs.
1. Your consent
By engaging with Howdy and providing us with your personal information, you consent to its collection, use and disclosure for the purposes described in this Privacy Policy. If you do not provide certain information, we may be unable to provide you with information or assistance.
2. How we collect your personal information
We collect personal information in a fair and lawful way, and not in an unreasonably intrusive way. We may collect it directly from you — for example, when you contact us, submit an enquiry, or correspond with us — and, where relevant, from third parties such as healthcare providers, pharmacies, suppliers, contractors and business partners, or from publicly available sources.
3. Types of personal information we collect
Depending on your interaction with us, this may include:
- your name, postal address, email address, phone number and date of birth;
- healthcare provider or prescriber details relevant to your access pathway;
- device and technical information such as your IP address, browser type, and website usage statistics; and
- sensitive health information, such as relevant medical history, medications, allergies and adverse events, where you provide it to us.
4. Why we collect and use your information
We use personal information to:
- respond to your enquiries and provide information and support;
- facilitate access to, and the supply and dispensing of, Howdy products through the appropriate regulatory pathways;
- communicate with you about your enquiry or treatment-related matters;
- maintain product quality, safety and adverse-event reporting;
- improve our products, services and website; and
- comply with our legal and regulatory obligations.
5. Disclosure of personal information
We may disclose your personal information to healthcare providers and pharmacies involved in your care, to our service providers (such as secure cloud hosting and payment processors), and to regulators or other parties where required or authorised by law. We do not sell your personal information.
6. How we protect your information
We hold personal information in secure electronic and, where applicable, physical records, and apply appropriate physical, procedural and technical safeguards. Access is restricted to those who need it to perform their role. While we take reasonable steps to protect your information, no method of transmission or storage is completely secure.
7. Marketing communications
As a medical cannabis brand, we do not advertise our products to the public or maintain a social media presence. Any communications we send relate to your enquiry or service matters. Where we are permitted to send you optional communications, you may opt out at any time by following the unsubscribe instructions or by contacting our Privacy Officer.
8. Cookies and website analytics
Our website may use cookies and similar technologies to collect aggregate information about how visitors use the site, so we can improve the experience. This information does not generally identify you personally. You can disable cookies in your browser settings, though some features may not function as intended.
9. Accessing and correcting your information
You may request access to, or correction of, the personal information we hold about you by contacting our Privacy Officer in writing. We will respond to your request within a reasonable time and in accordance with the APPs.
10. Overseas disclosure
We will not disclose your personal information overseas without your consent, except that some of our service providers (such as cloud hosting providers) may store data on servers located outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with this policy and the APPs.
11. Complaints and contact
If you have a question or concern about how we handle your personal information, please contact our Privacy Officer at hello@howdytherapeutics.com.au, or write to Level 8, Unit 805/220 Collins St, Melbourne VIC 3000. We will investigate and respond within a reasonable time.
