These Terms & Conditions ("Terms") govern your access to and use of howdytherapeutics.com.au (the "Site"). The Site is operated by Howdy Therapeutics (ABN 47 697 516 573) ("Howdy", "we", "us", "our"), which owns all Howdy brand rights. Distribution, storage and supply of Howdy products, and all other rights, are held by OZ Brands IE and Distribution (ABN 73 673 771 081), which holds the required licences. By accessing or using the Site, you agree to be bound by these Terms.
Important medical notice. Howdy products are prescription-only medicines and most are unapproved therapeutic goods that are not listed on the Australian Register of Therapeutic Goods (ARTG). They are available only to eligible patients aged 18 or over, accessed via the Special Access Scheme or through an Authorised Prescriber. This Site provides general information only. It is not medical advice and is not an advertisement for a therapeutic good. Always follow the advice of your healthcare professional.
1. Eligibility and acceptance
By using the Site you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you do not agree with any part of these Terms, you must not use the Site.
2. Licence to use the Site
We grant you a non-exclusive, worldwide, non-transferable licence to access and use the Site for personal, non-commercial purposes. You may view and print single copies of pages for your own reference. You must not:
- use the Site in any way that is unlawful, misleading, or harmful;
- copy, reproduce, distribute or commercialise any content without our prior written consent;
- submit content that is obscene, defamatory, offensive, infringes any third-party rights, or damages any person's reputation; or
- attempt to interfere with, disrupt, or gain unauthorised access to the Site or its systems.
We retain complete editorial control over the Site and may alter, amend, suspend or cease its operation at any time without notice. The Site may be unavailable from time to time, including for maintenance.
3. Intellectual property
Nothing in these Terms transfers any intellectual property rights to you. All trademarks, logos, designs, text, graphics and other content on the Site are owned by or licensed to Howdy Therapeutics. The "Howdy" name and brand are owned by Howdy Therapeutics. You must not use any of our intellectual property without our prior written permission.
4. No medical advice
Information on the Site is general in nature and is not a substitute for professional medical advice, diagnosis or treatment. We do not provide medical advice and cannot recommend any product for your individual circumstances. Decisions about treatment, including whether medical cannabis is appropriate for you, must be made by you in consultation with a qualified healthcare professional.
5. Products and supply
Howdy products are prescription-only medicines. They are supplied and distributed by OZ Brands IE and Distribution under the relevant licences and dispensed to patients by participating pharmacies in accordance with a valid prescription. Any supply of products is subject to all applicable Australian laws and the regulatory pathways described in the medical notice above.
6. Your warranties and responsibilities
You warrant that you have the legal capacity to agree to these Terms, that the information you provide to us is accurate and current, and that you will comply with these Terms and all applicable laws when using the Site.
7. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Site and its content are provided "as is" and we exclude all warranties, express or implied, regarding the Site's operation, availability, accuracy, or fitness for any purpose. We exclude all liability for loss of data, interruption of business, or any indirect, consequential or incidental loss or damage arising from your use of the Site.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the relevant services or the replacement or repair of the relevant goods.
8. Third-party links
The Site may contain links to third-party websites (such as the Therapeutic Goods Administration or independent review platforms). We provide these for convenience only and are not responsible for the content, products, or practices of any third-party site.
9. Termination
These Terms apply while you use the Site. They terminate automatically if the Site ceases to operate, and we may terminate or suspend your access immediately if you breach these Terms.
10. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.
12. Changes to these Terms
We may amend these Terms at any time by posting the updated version on the Site. Your continued use of the Site after any change constitutes acceptance of the amended Terms.
